Article VII. Zoning Districts and District Provisions

Sec. 27-19.  Zoning Districts

 

The zoning districts are designed to assist in carrying out the intent and purpose of the Comprehensive Plan and are based upon the Comprehensive Plan which has the purpose of protecting the public health, safety, morals, convenience and general welfare.

 

For the purposes of this chapter, the City of Le Sueur is hereby divided into the following Zoning Districts:

Sec. 27-20.  Zoning Map

The location and boundaries of the Zoning Districts established by this Chapter are set forth on the official zoning map which is herby incorporated as part of this chapter and which is on file with the City Clerk.

Sec. 27-21.  Rural Residential (R-1)

The purpose of this district is to allow for agricultural uses and single family residences as a transitional district.  It is designed specifically for areas within the City which are presently used for agriculture and open space, but may be converted to urban areas in the future.

 

1)       Permitted Uses

a.       Farmsteads, agricultural buildings, pole buildings, and agricultural uses except livestock feedlots

b.       Single family non-farm dwellings, but not more than one dwelling per lot, parcel or tract.

c.       Historic sites.

d.       Temporary or seasonal roadside stands with adequate off-street parking.

e.       Forest and game management areas.

f.         Public parks and recreation areas.

g.       Institutional uses.

h.       Essential public services – telephone, telegraph, power lines, cable TV, street, sewer and water, and any other necessary appurtenant equipment and structures.

i.         Home occupations subject to Article XV of this chapter.

j.         Steel covered structures.

k.       Swimming pools.

l.         Day care centers

 

2)       Accessory Uses

Any incidental machinery, structure or buildings necessary for the conduct of agriculture and other permitted uses.

 

3)       Conditional Uses

a.       Public and parochial schools of general instruction.

b.       Churches and similar places of worship and instruction, including parish homes.

c.       Cemeteries, including mausoleums, and crematories.

d.       Funeral homes.

e.       Hospitals, clinics, and sanitariums.

f.         Public and private riding stables.

g.       Greenhouses and seasonal businesses.

h.       Rest homes, boarding, and lodging homes.

i.         Day care centers and nursery schools.

j.         Golf courses.

k.       Storage buildings.

l.         Commercial recreation.

m.     Satellite dish antennas and other antenna devices subject to other zoning district requirements.

n.       Accessory apartments.

o.       Marinas

p.       Any other uses of similar character to those listed as permitted uses.

q.       Planned Unit Development

5)       General Regulations

a.       Additional requirements must be complied with concerning parking, signs, sewage systems, and other regulations as set forth in this chapter.

b.       Design standards as set for in Section 27-25

 

Sec. 27-22.  Urban Residential – Low Density (R-2)

This District is established to allow areas within the City of predominantly low density, single family detached dwellings and to preserve the quiet single family neighborhoods free from other uses except those which are both compatible with and convenient to residents of such districts.

 

1)       Permitted Uses

a.  One-family dwelling units.

b.  Historic sites.

c.  Public parks and recreation areas.

d.  Essential public services – telephone, telegraph,  power lines, cable TV, street, sewer and water, and any other necessary appurtenant equipment and structures.

e.  Signs.

f.    Home occupations subject to the standards in Article XV of this chapter.

g.  Swimming pools.

 

2)       Accessory Uses

Any incidental structure or building necessary for the conduct of a permitted use, including private garages, carports, and screen houses for use of occupants of the principal structures.

 

3)       Conditional Uses

a.  Public and private schools of general instruction.

b.  Churches and similar places of worship and instruction, including parish homes.

c.  Cemeteries, including mausoleums, and crematories.

d.  Hospitals, clinics, and sanitariums.

e.  Rest homes.

f.    Day care centers and nursery schools.

g.  Storage buildings.

h.  Commercial recreation.

i.    Planned Unit Development.

j.    Any other use of the same character as those listed as permitted uses.

 

4)       Minimum Lot Requirements and Setbacks

Detached residential garages or other accessory buildings located in the rear on-half of an internal lot shall be located no closer than ten (10) feet from side and rear property lines.  If entrance to the garage is off an alley, the setback requirements shall be 20 feet from the alley right-of-way.

 

With zero lot line homes, no portion of the structure or accessory appurtenance shall project over the zero side yard setback.

 

Where adjacent structures have front yard setbacks different from those required, the minimum front yard setback shall be the average setback of such structure, but in no case shall the front yard setback be less than thirty (30) feet.

 

5)       Minimum Floor Area

 

There shall be at least three livable rooms contained in each dwelling unit and each such unit shall have a minimum gross main floor area of 1,000 square feet.

 

6)       General Regulations

 

a.  Additional requirements must be complied with concerning parking, signs, fencing, sewage systems, and other items set forth in this chapter.

b.  Design standards as set forth in section 27-25 hereof.

Sec. 27-23.  Urban Residential – Medium Density (R-3)

This district is established to allow the continuation of existing residential development and the development of existing lots.

 

1)       Permitted Uses

All permitted uses allowed in the R-2 District and in addition, duplexes, triplexes, twinhomes, fourplexes, sixplexes, and manufactured homes.

 

2)       Accessory Uses

All accessory uses permitted in the R-2 District.

 

3)       Conditional Uses

a.  Board and lodging homes.

b.  Zero lot line homes with either detached or common walls.

c.  Planned unit developments.

d.  All conditional uses permitted in the R-2 district and multi-family dwellings not otherwise permitted.

e.  Bed and breakfast.

6)       Multi-family dwellings of two or more dwelling units.

Each additional bedroom above three (3) shall require 250 square feet of additional minimum floor area per dwelling unit.  A conditional use permit shall be required for dwellings above (6) units.

 

7)       General Regulations.

 

a)  Additional requirements must be complied with concerning parking, signs, sewage systems, and other regulations as set forth in this chapter.

b)  If a conditional use is granted for an apartment high rise, minimum lot requirements and set backs including height restrictions may be modified.

c)  Design standards as set forth in Section 27-25.

 

Sec. 27-24.  Multi-Family Residential (R-4)

The main purpose of this district is to allow high-density multi-family dwellings including apartments and town houses in the appropriate areas of the city.

1)       Permitted uses

All uses permitted in the R-3 district and in addition, townhouses, apartments, condominiums, and bed and breakfasts.

 

2)       Accessory uses

All accessory uses permitted in the R-2 and R-3 districts.

 

3)       Conditional uses

All conditional uses permitted in the R-2 and R-3 districts.  Heights exceeding maximum limits set forth on Section 27-24.4.

 

4)       Minimum Lot Requirements and Setbacks

6)       General Regulations

 

a)       Additional requirements must be complied with concerning parking, signs, sewage systems and other items as set forth in this chapter.

b)       Design standards as set forth in Section 27-26

 

Sec. 27-25.  Design Standards

Detached residential dwellings in Districts R-1 through R-4 shall have the following design standards:

1.       The Dwelling shall be paced on a permanent foundation

2.       Manufactured homes may be used as a detached dwelling in R-3 and R-4 districts provided that it is not constructed with a permanent hitch or other device allowing it to be moved other than for the purpose of moving it to a permanent site and which does not have permanently attached to its body or frame any wheels or axels and otherwise comply with Section 27-50

3.       A minimum width of the main portion of the detached dwelling shall not be less than 24 feet or at least 75% of its length and a minimum length of 30 feet.

4.       All principal buildings shall meet or exceed the minimum standards of the Minnesota State Building Code, the Minnesota Department of Health, and manufactured homes shall meet or exceed the requirements of the Minnesota State Building Code.

5.       A detached dwelling shall face the street.  Usually this means that the long access will be parallel to the street.  All exterior walls shall have the appearance of wood, glass or masonry regardless of their actual composition.

Sec. 27-26.  Manufactured Home Parks (R-5)

This district is established to allow manufactured home parks in areas of the City.  All manufactured homes shall be located in manufactured home parks unless otherwise set forth in this chapter.  Manufactured home parks shall provide ingress and egress roadways, storm shelters, open space for playgrounds, recreation and park purposes, necessary sewer, water and electricity and refuse services.

a)       Day care centers.

b)       Essential public services.

c)       Home occupations.

d)       Public parks and open spaces.

e)       Recreation facilities.

f)         Manufactured homes.

g)       Institutional uses.

h)       Manufactured home parks.

 

2.       Accessory Uses

Any incidental structure or building necessary for the conduct of a permitted use including private garages, car ports and screen houses for use of occupants of the principal structures.

 

3.       Conditional Uses

a)       Storage Facilities

b)       Swimming pools.

c)       Any other use of the same character as those listed as permitted uses.

d)       Mini storage

 

4.       Minimum Lot Requirements and Setbacks

Lot Size

Each manufactured home site shall contain at least 5,000 sq. ft of land for the exclusive use of the occupant.

The area occupied by a manufactured mobile home shall not exceed 30% of the total area of the manufactured home site.  An accessory structure such as an awning, cabana, storage structure, carport, windbreak and a roofed porch shall be considered to be a part of the manufactured home.

5.       General Regulations

a)       Additional requirements must be complied with concerning parking, signs, sewage systems and other regulations as set forth in this chapter.

b)       All manufactured home parks shall comply with the regulations set forth in article IX.

 

Sec. 27-27.  Central Business (B-1)

 

Sec. 27-28.  Fringe Commercial (B-2)

This district is established to accommodate the type of businesses that are not located in the Central Business District.

 

1)       Permitted uses shall include but not be limited to the following commercial businesses and non-profit enterprises:

a)       All uses permitted in the B-1 District.

b)       Shopping centers and malls.

c)       Restaurants.

d)       Bait and sporting goods shops.

e)       Parks and open space.

f)         Recreational facilities.

 

2)       Conditional Uses

a)       Residential land uses.

b)       Day care centers, day care and nursery schools.

c)       Retail establishments not listed under permitted uses which may meet the purposes of the district.

d)       Offices and other highway businesses, which in the opinion of the City will not have a detrimental effect on the fringe commercial and other zoning.

e)       Heights greater than what is permitted under paragraph 3 of this section.

4)       Screening and fencing

The City may require the screening or fencing of commercial uses on side and rear yards which face residential districts
